In Fresno, California, a federal grand jury returned two separate indictments charging Ricky Lee Allen and Demond James Hayden, both from Bakersfield, California, with being felons in possession of a firearm. The indictment against Allen says that he knowingly possessed a Hi-Point .380-caliber pistol after two felony convictions. One in 2009 for obstructing a police officer and one in 2001 for conspiracy to possess with intent to distribute cocaine base. The federal indictment against Hayden says that he knowingly possessed three weapons. A Hi-Point .45-caliber handgun, a Glock Model 22 .40-caliber handgun, and Mossberg 500 shotgun. The indictment indicates he was convicted in 2003 of possessing cocaine for sale and in 2006 of being a felon in possession of a firearm.
These cases are the result of federal criminal investigations by the FBI and the Bakersfield Police Department, which is as part of the Kern Country Violent Crime Gang Task Force. If convicted of these federal crimes, each defendant faces a maximum of 10 years in prison and a $250,000 fine. The actual sentence will be determined at the discretion of the federal court after consideration of statutory factors and the Federal Sentencing Guidelines.
