  • Willfully throw or project a rock, bottle, brick, metal, or other missile

  • With the intent to wreck the vehicle or cause bodily injury

  • And bodily harm occurs as a result

Penalty:

A conviction carries a sentence of 2, 4, or 6 years in state prison.

Penal Code 219.2 – Throwing Objects at Common Carriers

Penal Code 219.2 addresses situations where an individual willfully throws an object at a common carrier, even without intent to cause injury or damage.

This statute applies to throwing or projecting hard objects or missiles at:

  • Buses

  • Trains or railway cars

  • Cable or street railway cars

  • Passenger or freight vessels

Penalty:

PC 219.2 is typically charged as a misdemeanor, punishable by:

  • Up to 1 year in county jail or state prison

  • A fine of up to $2,000

  • Or both

Importantly, prosecutors do not need to prove intent to injure or actual damage—only that the act was willful.

What Is a “Common Carrier”?

A common carrier is any transportation service that offers public transportation of people or goods for a fee. Examples include:

  • Public buses and transit systems

  • Trains and railways

  • Commercial trucks

  • Passenger ferries and freight vessels
